These Terms & Conditions ("Terms") govern your use of rendinafamilyfoundation.org (the "Site") and your participation in programs and events of The Rendina Family Foundation, Inc. (the "Foundation," "we," "us," or "our"), including donations, event registration, sponsorships, auctions, and our text message program. By using the Site, registering for an event, donating, bidding, or subscribing to our texts, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.

1. About the Foundation

The Rendina Family Foundation, Inc. is a 501(c)(3) tax-exempt nonprofit organization (EIN 65-0800240) based in Jupiter, Florida.

2. Use of the Site

You may use the Site for lawful, personal, and non-commercial purposes. You agree not to interfere with the Site's operation, attempt unauthorized access, submit false information, or use the Site to send spam or harmful content.

All content on the Site, including text, graphics, photos, and logos, belongs to the Foundation or its licensors. RAISING THE B.A.R. is a trademark of the Rendina Family Foundation. You may not use our names, logos, or trademarks without our written permission.

3. Donations

• Donations are voluntary and are used to further the Foundation's charitable mission. The Foundation has sole discretion over how contributions are used, including contributions designated for a particular purpose.
• Donations are generally non-refundable. If you believe a donation was made in error, contact us within 30 days and we will review your request.
• Donations are tax-deductible to the extent allowed by law. For any single contribution of $250 or more, we will provide the written acknowledgment the IRS requires for you to claim a deduction, and we acknowledge gifts of any size on request. The Foundation does not provide tax advice; consult your tax advisor.

4. Event Registration, Tickets, and Sponsorships

• Payment. Registration, tickets, and sponsorships must be paid in full to be confirmed.
• Refunds and transfers. All registrations, tickets, and sponsorships are non-refundable and non-transferable.
• Rain or shine. Events take place rain or shine. If play is shortened, modified, delayed, or suspended because of weather, course conditions, or other circumstances beyond our control, no refunds will be issued. If the Foundation must postpone an event, registrations and sponsorships will be honored on the rescheduled date.
• Tax deductibility. When you receive goods or services in exchange for a payment (such as a round of golf, food, or beverages), only the amount above the fair market value of those benefits is tax-deductible. For any such payment over $75, we will provide a written statement with a good-faith estimate of the value of the benefits you received. For payments of $250 or more, that statement also serves as your written acknowledgment.
• Sponsor recognition. Sponsors grant the Foundation a non-exclusive license to use their names and logos to recognize their support in event materials, signage, on the Site, and on social media. Sponsors must provide logos and listing information by the deadlines we communicate in order to appear in printed materials.

5. Event Participation, Assumption of Risk, and Release

Golf and related activities involve inherent risks, including being struck by golf balls or clubs, golf cart accidents, uneven terrain, heat, and weather. By participating, you voluntarily assume these risks.

• You agree to follow all rules and instructions of the Foundation and the event venue, including golf cart rules. Only participants with a valid driver's license may operate golf carts.
• Alcohol will be served only to guests 21 and older. You agree to drink responsibly and not to drive while impaired.
• The Foundation may remove any participant whose conduct is unsafe, disruptive, or inappropriate, without refund.

To the fullest extent permitted by law, you release the Foundation, its directors, officers, employees, volunteers, sponsors, and the event venue from any claims for injury, loss, or damage arising from your participation, except to the extent caused by their gross negligence or willful misconduct. You are responsible for the conduct of guests you register.

6. Photography and Media

Our events are photographed and recorded. By attending, you consent to the Foundation's use of photos, video, and audio that include you, without compensation, in its event programs, website, social media, and other materials promoting the Foundation and its mission. If you prefer not to be featured, tell a Foundation representative at check-in or contact us and we will make reasonable efforts to honor your request.

7. Silent and Live Auction Terms

Our auctions are conducted in person and online through OneCause.

• Binding bids. Every bid is a binding offer to purchase the item at the bid amount. The highest bid at the close of bidding wins, as determined by the Foundation and its auction platform. The Foundation may set opening bids and minimum increments, reject any bid, withdraw any item, or extend or close bidding.
• Payment. Winning bids are due at the close of the event. By registering a payment card, you authorize the Foundation to charge it for your winning bids and any other purchases you make at the event.
• All sales final. Items are sold "as is," with no warranties. Descriptions and values are provided in good faith, often by item donors, and are estimates only. All sales are final; no exchanges or refunds.
• Pickup and delivery. Items must be collected at the event or by the date we communicate. Shipping or delivery, if offered, is at the winner's expense.
• Certificates and experiences. Gift certificates, travel, and experiences are subject to the provider's terms, including availability, blackout dates, and expiration dates. The Foundation is not responsible for the performance of third-party providers.
• Tax deductibility. Only the amount you pay above an item's fair market value may be tax-deductible.

8. Text Messaging Terms

Program. The Foundation's "RFF Event Alerts" text program sends event notices and reminders, check-in and schedule updates, auction announcements, bid and outbid alerts, checkout reminders, and receipts.

Opt-in. You may opt in by checking the text-message consent box at registration or check-in, providing your mobile number at check-in and agreeing to receive texts, or texting a published keyword to our toll-free number. Consent is not a condition of any donation, purchase, or registration.

Confirmation. When you opt in, we will send a message confirming your signup. By opting in, you agree to receive recurring automated informational and promotional text messages from the Foundation at the mobile number you provided. The Foundation may change the phone number messages are sent from.

Frequency and cost. Message frequency varies and increases around event days. Message and data rates may apply.

Opt-out and help. Reply STOP to any message to cancel; you will receive one confirmation message and no further texts. Reply HELP for help, or contact us at info@rendinafamilyfoundation.org or (561) 630-5055. Reply START to re-subscribe.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Privacy. See our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Changing your number. Before you change your mobile number or transfer it to someone else, reply STOP from the original number or email us at info@rendinafamilyfoundation.org with your old number, so we do not text its new owner.

Program changes. We may change or end the text program, or update these messaging terms, at any time. Changes take effect when posted. If you do not agree to a change, reply STOP to cancel; staying enrolled means you accept the updated terms.

9. Third-Party Services

Registration, donations, auctions, and payments may be processed by third parties, including OneCause and Stripe. Your use of those services is also subject to their terms and privacy policies. The Foundation is not responsible for third-party services or websites linked from the Site.

10. Disclaimers and Limitation of Liability

The Site and its content are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, the Foundation will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or participation in our programs. The Foundation's total liability for any claim will not exceed the amount you paid to the Foundation in connection with the transaction giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless the Foundation and its directors, officers, employees, and volunteers from claims arising from your violation of these Terms or your misconduct at our events.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Continued use of the Site or participation in our programs after changes are posted means you accept the updated Terms.
